2. Transfer of personal data to third countries
If we transfer data to third countries, i.e. countries outside the European Union, then the transfer takes place exclusively in compliance with the legally regulated permissibility requirements.
If the transfer of data to a third country is not for the performance of our contract with you, we do not have your consent, the transfer is not necessary for the assertion, exercise or defence of legal claims and no other exemption under Article 49 of the GDPR applies, we will only transfer your data to a third country if an adequacy decision under Article 45 of the GDPR or appropriate safeguards under Article 46 of the GDPR are in place.
Due to the declaration of invalidity of the EU-US Privacy Shield (ECJ 16.7.2020), processing in the USA is only possible with your consent pursuant to Art. 6 (1) a DSGVO. A transfer to the USA in the sense of the European data protection level is not guaranteed with the declaration of invalidity.
Alternatively or additionally, the conclusion of the EU standard data protection clauses issued by the European Commission with the receiving body create suitable guarantees in accordance with Art. 46 (2) c) DSGVO as well as an adequate level of data protection. 3. How and why we process your data
3.1 Contact form
You have the option to contact us via the contact form available on our website. This requires you to provide your email address, name and the reason (subject, message) for your contact. If a data subject contacts us by e-mail or via a contact form, the personal data transmitted by the data subject will be stored automatically. Such personal data transmitted by a data subject on a voluntary basis will be stored for the purpose of processing or contacting the data subject. The processing is carried out in accordance with Art. 6 (1) a DSGVO with your consent or in accordance with Art. 6 (1) b DSGVO in the context of pre-contractual measures to process your enquiry. This personal data is not passed on to third parties.
The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after processing your enquiry has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected.
3.2 Data protection for applications and in the application process
We collect and process personal data from applicants for the purpose of processing the application procedure. The legal basis of the processing is 6 para. 1 b DSGVO - pre-contractual measures as well as Art. 88 DSGVO in conjunction with § 26 BDSG - data processing for the establishment of an employment relationship. Processing may also take place electronically. This is the case in particular when applicants submit relevant application documents to the data controller by electronic means, for example by e-mail or via a web form located on the website. If you apply to us, the following data will be processed from you, for example: First name and surname, address, landline telephone number, mobile telephone number, e-mail address and, among other things, curriculum vitae, references and certificates.
If we conclude an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If no employment contract is concluded, the application documents are automatically deleted six months after notification of the rejection decision, provided that no other legitimate interests of the data controller conflict with such deletion. Other legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (AGG). Insofar as your application could be of interest for future job offers, we will store your application data for a further period of 12 months after you have expressly consented to such storage and use.
3.3 Technical access data
Every time you access our website, technical access data is stored as standard. These are for example:
• Information about the internet browser / operating system used
• requested and retrieved objects
• partial IP address of the computer requesting data
• Time and date of the server request.
This data cannot be assigned to a specific person. The anonymity of the respective user is thus preserved. The stored data is used exclusively for statistical purposes and to improve the attractiveness and usability of our website and, if necessary, to detect technical problems on our website at an early stage. We process this data on the basis of our legitimate interest in accordance with Art. 6 Para. 1 lit. f DSGVO.
3.4 Cookies
To obtain, manage and optimise your consent to the use of cookies and other services to operate our website, we use the service of Wix.com LTD (Wix.com LTD, 40 Namal Tel Aviv, 6350671 Israel). Wix.com LTD obtains the necessary consents from the user in accordance with data protection regulations before the functions of the website can be fully used. You have the option to give your consent for all services or only for certain services. NAME administers these and you have the right to revoke your consent at any time. You can revoke this yourself in the so-called "privacy settings" and adjust your settings. The use of this service requires the processing of your IP address and the storage of your preferences regarding the services to be used. How do cookies work?
The internet pages use so-called cookies in several places. A cookie is a small text file that is sent when a website is visited and is temporarily stored on the hard disk of the user/customer. • Google Analytics
Google Analytics is a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). It is used on the basis of Art. 6 para. 1 p. 1 lit. a DSGVO, with your consent. Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website such as

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. We have also added the code "anonymizeIP" to Google Analytics on this website. This masks your IP address so that your data is anonymised. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

Plugins of the social network Facebook of the operating company Meta Platforms Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland, hereinafter "Facebook") are integrated on our pages. We have integrated the link to the video platform YouTube of Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter: YouTube) on our website. If you wish, you can use the "YouTube button" or the share function. To do so, it is necessary to register with YouTube. Logging in has the effect of activating the provider's plugin.
When you click on a YouTube button on our website or on a YouTube video embedded on our website, a connection is established to YouTube's servers. This tells YouTube which website you have visited. • Content Delivery Network
For the purpose of a shorter loading time, we use a so-called Content Delivery Network ("CDN") for some offers. • Data transfer to credit agencies
We transmit your data (name, address and, if applicable, date of birth) to SCHUFA (SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden) for the purpose of checking your creditworthiness. A transmission takes place in the context of a concrete contract initiation with you.
We transmit personal data collected within the scope of a contractual relationship to SCHUFA about the application, the execution and termination of this business relationship as well as data about behaviour not in accordance with the contract or fraudulent behaviour.
The legal basis for these transfers is Art. 6 (1) b) and f) DSGVO. Transfers based on Art. 6 (1) f) DSGVO may only be made if this is necessary to protect the legitimate interests of us or third parties and does not affect the interests or fundamental rights and freedoms of the data subject. The exchange of data with SCHUFA also serves to fulfil legal obligations to carry out creditworthiness checks on customers (§ 505a and 506 of the German Civil Code).
SCHUFA processes the data received and also uses it for profiling purposes (scoring) in order to provide its contractual partners in the European Economic Area and in Switzerland and, if applicable, in other third countries (insofar as an adequacy decision of the European Commission exists in respect of these) with information on, among other things, the assessment of the creditworthiness of natural persons. • Right of objection
If we process your personal data for the purpose of direct marketing, you have the right to object at any time with future effect to the processing of personal data relating to you for the purpose of such marketing; this also applies to profiling insofar as it is connected with such direct marketing.
